Yeah, let the theif get off because nothing was lost in the end. Screw that. He stole it, he lied about it, he needs to accept responsibility for his actions and receive punishment. Be it a single phone bill, a tank of gas, or something involving the police.

Not really anything to do with the theft, but more with backing up your numbers - the 3125 is a smartphone so sync it with your computer . That way if anything happens to it, all your contacts, calendar events and emails are on both the phone and the computer. (This is assuming you use Windows on your PC and have Outlook.. which came with the phone.)

That is a more rational line of thought. Regardless of what you might do to prosecute him, it won't be as bad as what the phone bandit is facing trying to work for the honest guy that brought your phone back. Now that he knows he can't be trusted, that will bring a whole new dynamic to the work environment, if he hasn't already been fired.
The time to involve the police was when you noticed it missing.
As of right now, the police will most likely tell you the same thing I did, be glad you got it back and be more careful where you leave it in the future.
Consider it a cheap lesson.
