want to vent (wrecked the fusion)
so got i a wreck in the ford today. some dumb lady turned into me and to avoid a wreck i slamed my brakes on and ran off the road. in the process i trashed 2 wheels, knocked it out of alignment, and took a chunk out of the front bumper. then the lady leaves the scene. i call 911 then right after i get off the phone with them she comes back. says to me "did i hit you?". i say "no but you ran me into the median". she says "well i wasnt sure i knew i turned into you, then i saw you stop and get out the car, and i kept driving thinking it was okay, then i say you waving at me". i mumbled "yeah i was with a single finger lol". then about 5 minutes later the cop show up. asks me for my statement. not even halfway through min he just walks off i had to catch him to finish. he talks to her, and she tells him "i checked my mirrors and used my signal i didnt see him". the cop comes back to me and says she said "she didnt see you so no one is at fault since no contact was made", and he sent her off no ticket or nothing and now my mom is stuck with the repair bill . when we asked him if we could get her name so we could go to small claims he wouldnt give it to us. we got his badge number his superior will be getting a call later.

I hear ya, but basically the officer is viewed by the courts as one trained to make roadside judments as to if the evidence weighs giving a person a ticket. He heard both explanations and I assume from your post there were no other witnesses. Small claims will view it the same. Legally it'* a "wash". Welcome to no fault laws paid for the insurance lobby.
