I thought that most of the comments in the discussion were thoughtful and valid. The litigation pendulum certainly has swung to far and needs to come back towards a middle ground.

I'm with Lash. Although it seems like we should root for the manager and admire his bravery. Ligation ion such matters and possible scenerios leave companies like Home Depot no other policy to adopt. I feel for the guy, yet a host of things could have made his actions be the catalyst of lawsuits by the arrested, another employee hurt by the the capture, or a bystander/customer caught between the struggle. It is not indicative of the stores policy, most corporate stores have it now, it is of our judicial system that feeds our armies of lawyers and an ever increasingly liberal government bent on protecting criminals rights. The manager is not trained for what he did, did not know proper procedures, or the ramifications that could have been caused by his actions. Dont blame the store, blame what we have let our society become.

exactly what would happen where i work.
we have people trained to do stuff like that, theyre called Security or Loss Prevention. theres so much more to worry about when physically encountering someone, companies MUST send a message to their employees that if you dont have the training, you shouldnt be confronting ANY customer, even if shes 98 years old and driving as fast as she can on her motorized wheelchair.

It used to be wal mart would stop people and detain them... Wal Mart got away from that... Did away with security....
Lets put it this way.... Wal Mart doing away with security was actually in the paper...
We had a year with Loss Prevention where we only lost $14,000..... That was an extremely good year...
After security was dropped and this was advertised in the paper, So far we have lost $500,000....
And we are not to chase the thieves.... We have had people run out the door with computers and 1 or 2 have gotten away with HDTV'* Plasma and LCD

Yeah, that'* just nuts! You let your instinct take over, stop a thief, and lose your job for it. He was looking out for the store'* customers! He should be commended!
That kind of stuff is the reason I won't work for big corporations anymore...I've been sticking to small businesses most of my working years, and never had a problem with it...
The only times I had a problem with an employer, it was working for a corporation, i.e. Target, and Schwan'* (yes, I used to be a Schwan'* man)
Think about this next time you order from Schwan'*...
Schwan'* expects their salesmen to work 14 hour days, 5 days a week, and occasionally the 6 hour Saturday. If you don't log at least 11-12 hours of "sell time" a day, you will get "shunned" for lack of a better word... and my daily sales goal was $1200. Basically, extremely high expectations, for 11% commission. I walked out.
BUT back on topic...that kid sounds like he'* at least smart enough to not go back...

the real world is sad.
when I used to work at an Ace Hardware in high school, the managers told us that if we were ever robbed, that we were to bag the money for them, and hold the door for them on the way out.
