Your transmission casing shouldn't be that hot. Oil doesn't burn off the engine block..only exhaust manifolds.
Best way to tell if it'* leaking
A) Bring it in under warranty and have them deal with it.
B) Degrease and keep a look out.

Take it back and have them look at it...
The color of your fluid is already starting to show signg of overheating... You can tell by the brown hue in the fluid...
I'd take it back and have them look at it...

watch and listen to the revs. most of all these vids were shot in OD, i noted when i shifted into third.

Looks like they did something wrong when they rebuilt the trans...
The car needs to go back to them so they can check it out again...
It looks as if the first time you hit TCC lock the PCM is seeing too much slip in the trans and locking you out of 4th gear...
Did you happen to notice an OD shift at all? And to top it off it looks like your trans is getting weak.... I'd be having a fit with the builder
OK looked at the Vids again... Doesn't look like the trans ever went into OD...
When they installed the new trans did they ever flush the passages in the radiator for the trans fluid? Or add a cooler as a bypass for the internal cooler?

im not sure if they flushed the passages, but i know there isnt any internal cooler.
the thing im wondering it, wouldnt the blocked passages show up earlier? or do you think theres new metal floating around?

I'm thinking more along the lines if the passages in the radiator were blocked or there may have been trash in there its possible that there could have been a lack of fluid flow for the trans... This will cook the trans.... Your car seems to be a lot slower than it was, thats trans is going to the dogs in a hurry...
And you have Burnt trans fluid? Is the fluid getting any darker?
When was the trans rebuilt and what kind of warranty did it have?

i didnt check it today. im gonna go for a drive soon and ill take a pic of it later
early december 05, 12mth/18k mi. so im still under that. i feel like goin and bein a moron and blowin it to hell so i can get it rebuilt no questions asked.
